Website Maintenance Plans

• Website Maintenance is purchased on a month-to-month basis, after a three (3) month minimum commitment. Client can cancel at any time after the initial three month period and services will cease at the end of the current billing cycle. (See Paragraph 15 for cancellation information.)
• Website Maintenance is defined as updates and changes to your website, after the initial site build is complete, has been uploaded to the server, and final revisions have been made and approved.
• Website Maintenance is not performed on 3rd party apps that are integrated into your website, for example: 3rd party scheduling apps or other platforms that require a separate log in to access. Updates to any content therein can be provided if the content can be accessed via the website itself.
• Photos and other graphics needed for updates are to be provided by the client. If necessary COWGIRL MEDIA can supply graphic design work, stock images or photography services for an additional fee.
• COWGIRL MEDIA will access your site once per month (typically on the 1st of every month, depending on the day of the week). All monthly maintenance updates and any client change requests are performed during this session, therefore it is highly recommended that any updates needed are submitted by the 25th of the prior month, to ensure that the work will be performed in a timely manner. If Client change requests are needed outside of this session, additional charges may apply.
• Search engine optimization services are not included. SEO packages can be purchased separately for an additional fee.
• Any changes that the client or another designer makes to the website themselves that result in needed repair by COWGIRL MEDIA will not be covered under this maintenance agreement and will result in additional charges for said repair.
• Changes to the website requested by the client that exceed the limits of their current maintenance plan will result in additional hourly charges at COWGIRL MEDIA’s current hourly rate.
• All website content submitted for updates is required in electronic (digital) format. Website copy should be the final copy and suitable for copy/paste. If it is not suitable for effective website copy as determined by COWGIRL MEDIA, copy-writing services are available for an additional fee.
• Basic resizing of photos required for updates is included, however any additional graphic design work will be charged accordingly. All graphics must be supplied in digital format.
• Copyrights and Trademarks. The client represents to COWGIRL MEDIA and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to COWGIRL MEDIA for inclusion in project are owned by the client, or that the client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend COWGIRL MEDIA and its subcontractors from any claim or suit arising from the use of such elements furnished by the client.
• Invoicing & Payments. Maintenance Plan payments are to be paid in advance via a subscription and charged to your credit card on file automatically. Maintenance work will not be performed until payment has been received in full. Any additional work performed to the Client’s website will be invoiced at the end of the month, at the normal rates for that service.
• Payment Failures. If monthly payment lapses, the system will auto-retry your payment daily for a period of one week. CLIENT has a 15-day grace period in which to provide an updated payment method or fund your account, or maintenance services will cease and this contract will be nullified. To begin again, another Maintenance Plan agreement will be issued, however monthly fees will increase to $79 per month for the duration of the service.
  Maintenance work will not be performed until payment has been received in full. If CLIENT misses 3 automated payments in a 12-month period due to credit card failure or insufficient funds, a $15 fee will be charged for each subsequent missed payment going forward.
• Pricing is subject to increase at any time, however a 30 day email notice will be provided as notification. All terms of the initial Website Design Contract remain in effect.
• Warranties, Disclaimer and Liability. While having a maintenance plan in place can dramatically decrease the chances of hacking or malware, COWGIRL MEDIA cannot guarantee that this will never occur. Having a website maintenance plan in place includes a site restore from website backups included with all Cowgirl Media hosting plans.  In no event shall COWGIRL MEDIA be liable to the CLIENT or any third party for any damages, including lost profits, lost savings or other damages arising from hacking attempts or malware on the site.
• Maintenance plans are a month-to-month service (after the initial three month commitment) and can be cancelled at any time. Cancellation requests must be delivered by email: phone calls, text messaging or DM messages via social media will not be accepted. There are no refunds given for prorated amounts.
